What personal information JORIS Buyers Agent and JORIS Home collect, why we collect it, who sees it, and how you can ask to see or change it.
This policy covers two separate businesses, both run by Joris Cuesta:
“We” means whichever of the two you’re dealing with. Both use the same systems and Joris looks after both, so information you give one may be seen by the other. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
Some of our work touches on personal circumstances, such as a separation, a bereavement, health or a move into aged care. We only record what you choose to tell us and what we need in order to help you.
We may also receive information about you from people you’ve asked us to deal with, such as your solicitor or mortgage broker, from someone who referred you, and from public sources such as property records.
You can browse our website without telling us who you are, and ask general questions without giving your name. We can’t act for you without knowing who you are.
We don’t sell your personal information.
People involved in your purchase, sale or renovation, where that’s part of the service or you’ve asked us to, such as selling agents, solicitors and conveyancers, mortgage brokers, building and pest inspectors, builders and designers.
Providers that run our systems:
Regulators, courts or others where the law requires it.
Most of these providers store or process information outside Australia: mainly in the United States, and for some in the United Kingdom and the European Union. Cloudflare operates worldwide. Those countries’ privacy laws may differ from Australia’s. We use established providers and give them only what they need to do their job.
We may use AI tools to help with our work, for example to sort website enquiries (filtering spam and working out which service you’re asking about) and to help draft emails and documents. Joris decides who we work with and what we advise you, not software.
If we prepare a property report for you, it’s kept at a private web link. It may include your first name, the property, and our view on price and strategy. We record when the link is opened and whether that was on a phone or a computer, so we know the report has been read. We don’t record who opened it, their IP address or their location. Anyone with the link can open it, so please only pass it to people you’re happy to have it.
A link expires after 12 months unless we tell you otherwise, and the report is then deleted. Ask us and we’ll turn it off sooner.
Our website uses cookies and similar tools. Some make it work, such as the security check on our forms, chat and call booking. Others show us how the site is used and whether our advertising works: Google Analytics, Google Ads, the Meta Pixel, Cloudflare Web Analytics and HubSpot’s tracking code. Google and Meta may use this information to measure and target advertising, including on other websites.
The site also keeps a note in your browser of how you arrived, for 30 days, and sends it with any enquiry you make, so we know what’s working.
You can block or delete cookies in your browser’s settings. The site will still mostly work, though chat, call booking and form security checks may not. Google and Meta also let you control personalised ads in your account settings.
We keep personal information for as long as we need it for the purposes above, and for as long as the law requires, including the record-keeping rules for licensed property agents. After that we delete it or remove what identifies you.
We keep it in password-protected systems and limit who can see it. No system is completely secure. If a breach is likely to cause you serious harm, we’ll tell you and the regulator as the law requires.
You can ask what we hold about you, ask us to correct it, or ask us to stop contacting you. Email [email protected]. We’ll reply within 30 days. If there’s something we can’t do, such as deleting records we have to keep by law, we’ll tell you why.
If you’re unhappy with how we’ve handled your information, tell us first using the details below, and we’ll reply within 30 days. If that doesn’t resolve it, you can complain to the Office of the Australian Information Commissioner.
We’ll update this page when what we do changes. The date at the top shows the last update.
